TERMS AND CONDITIONS
1.The contract between us
Full payment must be received for the whole of the price of the goods that you order before your order can be accepted. When full payment is received by us we will confirm that your order has been accepted and send you an email at the email address you provide in the order form. Acceptance of your order brings into existence a legally binding contract between us.
2. Our right to refuse your order
We reserve the right to refuse to accept your order for any for any of the following reasons:
- We have insufficient stock to deliver the goods you have ordered.
- We do not deliver to your area.
- The goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
- If we refuse your order we will notify you by e-mail straight away and will re-credit your account any of the sum deducted by us from your credit card as soon as possible or within 30 days of your order. Any additional compensation for disappointment suffered will be at our discretion.
3. Pricing
- Prices payable for goods that you order are all set out in our website.
- In some cases you may be required to pay extra for delivery and also it might not be possible for us to deliver to some locations. All delivery charges are set out in the website.
- All orders are processed in GBP at the prices displayed on the website at time of order. Conversions into other currencies are approximate. Some prices may change slightly between the order date and date of dispatch.
4. Your right to cancel your contract
- You may cancel your contract with us for the goods you order within 7 days of the order. You do not need to give us a reason for cancelling your contract or pay any penalty.
- You must notify us in writing as soon as possible if you wish to cancel your contract.
- All goods received before you cancel your contract must be sent back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received but send the goods back to us at our contact address at your own cost and risk as soon as possible.
- Once notification has been received by us that you wish to cancel your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible or within 30 days of your order.
- If you cancel the contract but do not return the goods to us in the condition they were in when delivered to you or do not pay the costs of delivery, then we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
5. Delivery of goods
- Goods will be delivered to you at the address you give us for delivery at the time you make your order.
- Delivery will be made as soon as possible after your order has been accepted or within 30 days of your order.
- Ownership of the goods will be yours once they have been delivered to you. When goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
6. Notices
Notices from you to us must be in writing and sent to our contact address at 22 Ten Ltd, Atlantica House, 11 Station Rd, St Ives, Cambs, PE27 5BH.
7. Events beyond our control
We will not be liable for failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any circumstance beyond our reasonable control including, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, accident, flood, fire, or explosion.
8. Governing Law
The contract between us shall be in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
9. The agreement
The above terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out our agreement relating to the supply of the goods to you by us and except where you are dealing as a consumer.
- Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us.
- Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being misleading or untrue.
